Rick Hauser ABR EBB EBA GRI, and Krystyna Stachurska EBA, recently attended the 11th Annual Conference of the National Association of Exclusive Buyer Agents (Naeba) in San Francisco, California, as well as the National Association of Realtors Conference in San Francisco. Rick states: "The training we receive at the Naeba conferences is heads and tails above any buyer-representation training in the traditional Real Estate industry - including the ABR course -- or courses that one might receive from the National Association of Realtors National Convention. It's like the difference between playing in the National Football League versus playing High School football."

"EBA's are specialists, and they are noted by consumer watchdog and advocacy organizations as being the best thing since sliced bread for home buyers. Exclusive Buyer Agents (EBA's) received a lot of positive press this year - to include a Consumer Reports May 2005 magazine article, and a CNN Money article - to name a few. Though we receive approximately 95% of our clients from past client referrals - those National Articles helped grow our business this year. We've had a record year - tripling our volume from 2004 - so we recently moved from Palatine to Hawthorne Woods to double the size of our office. "When home buyers work with us - they like not having to worry about things they might have to worry about -- with an ordinary agent. They don't have to worry that we aren't going to tell them about the negatives of a property - since as their "exclusive buyer agent" - we are their unbiased consultants and advocates. They feel comfortable in knowing that we don't "sell" them a home, but rather - we are consultants that empower them with the best possible information, in order to allow them to make their most informed decision, without anyone being "pushy." "I have tremendous respect for listing brokers, and the time, energy, money it takes to market properties effectively. True buyer agency also involves heavy demands. It is very satisfying to go to a closing knowing that I've done due diligence and hard negotiating in the same way that the listing agent has served his or her seller."

"What I don't have respect for are listing agents who distort the truth - so we have to keep our eye out for the misrepresentations, for our clients. For example - when showing one of our clients a home that they wanted to write a contract on - the sheet on the house said "Newer furnace and AC." The furnace and AC didn't look very new, and in fact - when we investigated - they were both about 25 years old. I called the listing broker (national chain) and listing agent - asking them how they could advertise "newer" - and the answer received from the listing agent was -- "it had a couple of new parts." A few weeks later - the listing broker finally had the agent change the wording, though the agent still uses it in her feature sheet. We also think it is unfair to consumers that they can unknowingly get into conflict of interest situations that they weren't expecting -- when they hired a "buyers agent." . But I guess if it wasn't for the "buyer agents" that work for companies listing property for sale - we wouldn't have all the excellent advantages that we do for home buyers."

"Many people are not aware of the difference between a "buyers agent" and an "exclusive buyer agent." An "exclusive buyer agent" (EBA) works for a company that never "takes listings" (in other words - never represents sellers.) They do this in order to provide guaranteed unbiased home showing, and so theres are no conflicts of interests. EBA's may also show a wider selection of properties - including all for-sale-by-owner properties, Of course - it goes without mention that they specialize in working for home buyers 100% - 100% of the time.

In contrast, a "buyer agent" works for a company that lists property for sale. A "buyer agent" might list property 95% of the time, and only work with buyers 5% of the time - calling themselves a "buyers agent" when they work with a buyer. So - usually unknown to the consumer - they aren't specialists. They may also have a tendancy to show more of their own company's listings (since they may get compensated more for selling an "in-house listing") or worse yet - push their own listing on their buyer client, so that they can get what the industry refers to as the "double dip" commission."

"They probably won't tell their own buyer client about the negatives of their own listing, and that might also apply to their company's in-house listings. If the buyer is interested in their agent's listing - the agent either has to suddenly declare "dual agency" to their buyer (meaning that they are now representing the buyer and seller equally - which is really non-representation) - or shuffle them off to someone else in their office "designating" them to be the new agent for the buyer. Meanwhile - they are now representing the seller and have that buyer's confidential information (though they are not supposed to reveal that to the seller.) Nevertheless - the serious potential remains for the compromising of the buyer's information and negotiation position." A few years ago, we told one of our buyer clients that the Route 22 bypass in Lake Zurich was going to go right behind the house that they were seriously considering. The backyard at the time was very secluded - surrounded by a row of trees, which was very appealing to them. We informed them that that "solitude" was going to be going away in a few years thanks to information we obtained from the Lake Zurich Planning Commission. They were very grateful for that "negative information" about the property, which they may not have received from an ordinary agent.
