Confidentiality:
We won't tell the seller, his agent, or anyone else anything you don't want them
to know. We won't reveal your negotiating strategy, financial position or top
price.
Accessibility: We will show you every property that might be suitable. We
will not avoid so-called troublesome properties such as renter occupied, for
sale by owner, foreclosures, probate and government-owned.
Reasonable Care: We'll use our expertise, negotiating skills and
knowledge to your benefit. We will make available lists of qualified experts,
such as property inspectors, termite companies, lenders and insurers.
Loyalty: You'll have our undivided loyalty. We can show you any property
and we can negotiate on your behalf without prejudice because we do not list
property for sale.
Obedience: You're the boss! we'll obey your lawful instructions in
dealing with your real estate business. We will give helpful advice so you can
make informed decisions.
Accountability: We'll account to you for any money or property we handle
for you.
Disclosure: We will tell you everything we know or can learn - good or bad
about the property, its value, or the seller's motivations. We will run a
comparable market analysis, so you will know if the property is priced above or
below the current market for the neighborhood.
Because we do not list homes
for sale, we have no financial interest in which home you buy. We will provide
you an overview of the entire market with the certainty that we will not try and
steer you to a home listed by a particular brokerage. Our only goal is that you buy the best possible
home for you, at the lowest possible price.
After
we meet with you, and assuming we accept you as our client - the first
thing you will need to do is to get pre-approved by a loan officer. Your
pre-approval means that we won't be looking at homes that are out of your
true price range - wasting your time and ours. You will also have more power in negotiations
when we write a contract that is backed by a pre-approval letter.
If
you want to search the Multiple Listing
Service (MLS) now - you can - but it isn't nearly kind of refined/exact/complex
search we will set up for you - on a personal web page, just for you - when
you become our client.
We
also expand the search to other types of properties - including for-sale-by-owner,
pre-foreclosures, foreclosures and providing pre-construction pricing "intelligence"
for new construction.
Our
job goes beyond just searching for the right property for you - and finding
it. It also involves complex research to determine the seller's situation,
the neighborhood and community market situation, and creating a negotiation and
financing strategy for you that works, as well as providing complimentary
post-sale Lifestyle services.
SERVICES PROVIDED IN
THE INITIAL INTERVIEW PHASE
- Our Agents disclose that
they are an Exclusive Buyer Agent, and they define their agency relationship
to you. They will explain how different agency relationships may affect
the level and type of service you may receive from a real estate agent.
- Our
Exclusive Buyer
Agents
enter into a written Agency Agreement with their Buyer-Clients. The agreement
will include beginning and ending dates, the service fee structure and payment
method, and the responsibilities of both parties.
- Our Exclusive Buyer Agents
will make themselves available to their Buyer-Client in a timely manner.
- Our Exclusive Buyer Agents
will pledge absolute confidentiality to a Buyer-Client when representing them,
thereby protecting that Buyer-Client's ability to negotiate all aspects of
the transaction.
- Our Exclusive Buyer Agents
will counsel a Buyer-Client regarding their financial qualifications
and will assist that Buyer-Client in seeking and working with mortgage lenders.
Our Exclusive Buyer Agents will not direct their Buyer-Client to any one lender,
but instead will assist him/her in evaluating lenders based on their customer
service levels or personality-fit with the client, as well as having an array
of loan programs to choose from, that have low interest rates and costs for
the buyer's given situation.
- Our Exclusive Buyer Agents
will assist their Buyer-Client in seeking and working with, excellent Real
Estate attorneys.
SERVICES PROVIDED IN
THE GENERAL PROPERTY SEARCH PHASE
- Our
Exclusive Buyer
Agents
will discuss objectives and preferences in
property styles, age, floor-plans, and so forth with a Buyer-Client, then
develop from this information a suggested property profile for
him/her.
- Our
Exclusive Buyer
Agents
will provide their Buyer-Client with information about the communities and
community amenities, neighborhoods and neighborhood amenities, and other information.
- With a Buyer-Client's
target property profile in mind, our agents will search the real estate
market, including properties offered by "for sale by owners"
and builders, to locate properties to show that Buyer-Client.
- Our Exclusive
Buyer Agents
will provide near real-time updates to the Buyer-Client by setting up a personal
web page for them - showing them properties that meet their criteria from
a near "real time search of the entire multiple listing system (MLS)."
Via their own password-protected web page - Buyer-Clients receive color pictures
of homes, along with the home's data such as price, days of market, room sizes,
features etc. They will also receive "satellite shots" of
the local topography, and sometimes, neighborhood views. If any homes meeting
the criteria are new on the market - our buyer client is automatically alerted
via e-mail. Buyer-Client can annote comments about each property and
mark "Interested" or "Maybe" or "Not Interested"
on each property - which our Exclusive Buyer Agent can view online.
- Our Buyer-Clients will
receive full information sheets on each home, as they are toured, when available,
and will be informed of what the seller's "co-op" is, for any property,
prior to making an offer.
- If
you like - we'll research homes for you - that have been on the market for
awhile - where the seller may be very flexible, or look for homes that have
recently been "price reduced." We'll even help arrange a "no-money-down"
deal if necessary.
Have you been told by an agent that a "no-money-down"
is impossible? It isn't!
SERVICES PROVIDED IN
THE PROPERTY SELECTION/CONTRACT OFFER PHASE
- Our
Exclusive Buyer
Agents
will discuss and evaluate the
properties viewed with their Buyer-Client, comparing each property shown
with their initial specifications.
- Before preparing an offer
to purchase, our Exclusive Buyer Agent will inform a Buyer-Client about any
defects or problems he/she has observed or in any way discovered regarding
the target property. Our
Buyers Agent will honestly explain the advantages and disadvantages of each
property our Buyer-Clients consider.
- Before
preparing a contract offer on behalf of their Buyer-Client, our Exclusive
Buyer Agent
will prepare a comparative market analysis, including explanations and documentation,
to determine the target property's approximate market value - and adjust the
analysi for any minor variations in property characteristics - like an appraiser
does. Our Exclusive
Buyer Agent
will not prepare an offer to purchase a property he/she has not personally
seen with the client.
- Before a Buyer-Client signs an offer to purchase,
our Exclusive
Buyer Agent
will provide the Buyer-Client with an estimate of closing
costs and, whenever possible, with the truth-in-lending estimate provided by
the mortgage company.
- Our Exclusive Buyer Agent
will
counsel his/her Buyer-Client and explain the choices available in completing
a real estate contract. This real estate counseling is based upon a
Exclusive Buyer Agent's experience in negotiation and real estate business decisions and is
not legal advice. Legal matters should be identified and a Buyer-Client
advised to seek legal counsel where appropriate.
- Our Exclusive Buyer Agent
will prepare the contract offer on a form which has been designed to
protect a Buyer-Client's interest.
- Our
Exclusive
Buyer Agent
will develop contract negotiation strategies with their Buyer-Client, establishing
pre-set limits on key points of negotiation when that Buyer-Client wishes
to do so. Our Exclusive Buyer Agent will actively negotiate only on
behalf of their Buyer-Client. Our
Exclusive Buyer
Agent will present all counter-offers by the seller in a timely manner
to their Buyer-Client.
- Before
submitting a contract offer to a Seller, our Exclusive
Buyer Agent
will counsel their Buyer-Client regarding the time requirements specified
in the contract and will encourage that Buyer-Client to have professional
inspectors inspect the property if the contract is accepted. We will book
the appointment for the inspection with the inspector if our Buyer-Client
requests this no-cost service.
SERVICES PROVIDED IN
THE ESCROW-TO-CLOSING PHASE
- Our Exclusive Buyer Agent
will counsel a Buyer-Client about the types of home inspectors, the
suggested criteria for selecting home inspectors, and the comparative costs
of inspection services. Our Buyer-Client will be responsible for
selecting their real estate inspector. Our Buyer Agent will encourage
his/her Buyer-Client to be present during inspections.
- Our Exclusive Buyer Agent will notify a Seller or a Seller's Agent in writing of inspectors'
findings and of corrections/repairs mandated by a Buyer-Client. Our
Buyer Agent will specify a Buyer-Client's desire to proceed or cancel the
purchase contract whenever such notification is required.
- Our Exclusive Buyer
Agent will maintain contact with the Buyer-Client's title company and
mortgage company to make sure that the Buyer-Client's interests are
being protected.
- Our
Exclusive Buyer
Agent
will review a settlement statement
with their Buyer-Client at or before closing, if possible.
- Our Exclusive Buyer Agent will accompany their Buyer-Client on a property walk-through before
closing.
- Our Exclusive Buyer Agent will attend a closing with their Buyer-Client. Our Buyer Agent
is prepared to support their Buyer-Client's position at closing.
- Our
Exclusive Buyer
Agent
will keep records of transactions
for a reasonable period of time, and will provide this information to their
Buyer-Client on request.
